Terms of service

These terms cover your use of tryduven.com and anything you buy from us. By placing an order you agree to them. If you do not agree, do not use the site.

Duven is operated from 1209 Mountain Road Pl NE, Albuquerque, NM 87110, United States. In these terms, "we", "us" and "Duven" mean that business, and "you" means you.

Who can order

You need to be at least 18, or have a parent or guardian place the order for you. You need to give us a real name, a real email address and a real delivery address. If any of that is wrong we may not be able to deliver, and we are not responsible for parcels sent to an address you typed incorrectly.

Orders and pricing

All prices are in US dollars. We try hard to keep prices, descriptions and stock accurate, but mistakes happen. If a product is listed at the wrong price or with the wrong description, we can cancel the order and refund you in full before it ships. We will tell you why.

Placing an order is an offer to buy. The contract is formed when we send you a shipping confirmation, not when you get the order confirmation email. We can refuse or cancel any order, including where we suspect fraud, where the delivery address looks invalid, or where someone is buying at a volume that looks like resale.

Payment

Payment is taken at checkout through our payment providers. We do not store your full card details. If your payment is reversed or charged back after we have shipped, we may recover the amount owed.

Using the products safely

Duven sells general consumer products. They are not medical devices, safety equipment or professional tools, and nothing we publish is professional advice of any kind.

Read and follow any instructions supplied with the product. Use each product for its intended purpose only, keep small parts away from children, and stop using anything that is damaged. Do not open, modify or attempt to repair a product yourself.

Battery-powered products

Some of our products contain rechargeable lithium batteries. Charge them only with the cable supplied or an equivalent certified charger. Do not leave them charging unattended for long periods, do not expose them to extreme heat, fire or water beyond their stated rating, and do not puncture or crush them.

If a battery or product becomes hot, swollen, discoloured or gives off an odour, stop using it immediately, disconnect it, and contact us. Dispose of batteries and electronics through your local recycling scheme rather than in household waste.

Audio products and hearing

Listening at high volume for extended periods can damage your hearing. Set the volume to a comfortable level and take breaks. Do not use earphones or headphones while driving, cycling, or anywhere else you need to hear what is around you, and check your local laws before doing so. You are responsible for using audio products safely.

Product descriptions and results

Photos and descriptions are as accurate as we can make them, but colours vary between screens and small dimensional differences happen between production runs. Battery life, range and performance figures are manufacturer estimates measured under test conditions and will vary with real-world use. Where we describe how customers typically get on with a product, that is a general description and not a promise about your experience. If it does not work for you, the refund policy covers you.

Our content

The Duven name, logo, site content, product photography and copy belong to us or are used with permission. You may not copy, republish or use them commercially without our written permission. You may share links to our pages freely.

Things you may not do

Do not use the site to break the law, to interfere with how it runs, to scrape it at scale, to attempt to access accounts or data that are not yours, or to submit false information. We can suspend access if you do.

Reviews and anything you submit

If you send us a review, photo or comment, you keep ownership of it but you give us permission to use it on our site and marketing. Do not send us anything you do not have the right to share. We may remove content that is abusive, misleading or unlawful.

Third party links

Some pages link to sites we do not run. We are not responsible for their content, their products or their privacy practices.

Disclaimer and limits on our liability

The site and the products are provided as they are. To the fullest extent the law allows, we exclude implied warranties. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited, and nothing here removes rights you have as a consumer under the law where you live.

Where liability can be limited, our total liability to you for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including lost time, lost profit, or damage to property arising from misuse of a product.

Indemnity

If your misuse of the site or a product causes a claim against us from someone else, you agree to cover the reasonable costs of dealing with it.

Governing law

These terms are governed by the laws of the State of New Mexico, United States, and the courts there have jurisdiction, without affecting any consumer protection rights available to you where you live.

Changes

We can update these terms. The version published on this page at the time you order is the one that applies to your order.
